בעת חתימת החוזה, שני הצדדים, השוכר וחברת ההשכרה, מחוייבים בכל תנאיו. השוכר מתחייב לשמור על הקרוואן ולא לפגוע בו במכוון ולחשוף אותו לסכנות.
תנאי ההזמנה והתשלום
בעת אישור ההזמנה, השוכר חותם על החוזה ובו כתוב: "אני מכיר את תנאי החוזה וההשכרה ואני מקבל אותם". ברגע זה כל מה שכתוב בחוזה מחייב את שני הצדדים. כלל זה תקף גם בעת הזמנה טלפונית או דרך האינטרנט. תנאי הכרחי לקיום החוזה הוא ביצוע התשלום.
בעת אישור ההזמנה, יש לשלם 40% מעלות ההזמנה. בעת עונת השיא, כל סכום ההזמנה, צריך להיות משולם עד 20 יום מתחילת ההשכרה, אחרת ההזמנה תיחשב כמבוטלת.
ביטול הזמנה
ביטול הזמנה מחוייב בדמי ביטול בהתאם לתנאים.
במקרה של ביטול הזמנה ללא הודעה, 100% מהסכום לא יוחזר בנוסף להוצאות אחרות העלולות להיווצר כתוצאה מהביטול.
חברת ההשכרה בשיתוף חברת הביטוח מציעות ביטוח "סיכון לביטול".
במידה והשוכר אינו מסוגל לבצע את ההשכרה, הוא יכול להעביר את ההזמנה ללקוח אחר העומד בכל התנאים ויש לעדכן על כך את חברת ההשכרה. בכל שינוי בהזמנה קיימת קיימים, כל עוד ניתן לבצע את השינוי, השוכר ישלם דמי שינוי על סך 35 €.
כל שינוי בתאריך ההשכרה שנעשה בתוך חודש מלפני תחילת ההשכרה יחושב כביטול ויחוייב בדמי ביטול בהתאם.
פיקדון
בעת קבלת הקרוואן, יש להשאיר 1000 € דמי פיקדון בכרטיס אשראי או מזומן.
הסכום מיועד לכסות עלויות הבאות הנגרמות במהלך ההשכרה:
• 1% מערך הקרוואן המשולם בההתתפות העצמית בביטוח המקיף במקרים של תאונה או גניבה של הקרוואן.
• ביטול העדר תביעות של חברת הביטוח.
• חוסר או נזק לציוד.
• תיקון נזקים שלא מכוסים ע"י הביטוח המקיף של הקרוואן.
הפיקדון חוזר לשוכר בסיום ההשכרה במידה והקרוואן והציוד לא נפגעו או שהקרוואן גרם נזק למישהו אחר ואין תביעות נוספות.
במקרה של גרימת תאונה, או מעורבות בתאונה הפיקדון נלקח מיידית לכיסוי עלויות הציוד או נזקים שלא מכוסים ע"י חברת הביטוח המקיף.
במקרה של נזקים גדולים במיוחד או גניבה של הקרוואן השוכר מחוייב להתקשר מיד למשטרה, למלא דו"ח ולהציגו לחברת ההשכרה בסיום ההשכרה. במידה ולא יעשה כך השוכר יהיה מחוייב לשלם את כל הוצאות החזרת הקרוואן למצבו התקין. בכל מקרה, גם במקרים של נזק קטן לקרוואן - על השוכר להודיע מיד לחברת ההשכרה.
קבלת הקרוואן ותקופת ההשכרה
במהלך עונת השיא, השכרת קרוואנים אפשרית רק מיום שישי ליום שישי (7, 14 ו-21 יום). אין אפשרות להשכרות מתחת ל-7 ימים במהלך עונת השיא למעט במקרים מיוחדים. מחוץ לעונת השיא אפשר להשכיר לתקופות קצרות יותר.
קבלת הקרוואן תהיה בין 12:00 ל-16:00. במקרים מיוחדים באישור מיוחד ובתוספת תשלום אפשרי גם מחוץ לשעות אלה.
בתיאום מראש - אנו מציעים לעיתים שירות הסעה אל/מאת שדות התעופה בעלות של 0.80 € לק"מ.
בעת קבלת הקרוואן מתבצע תהליך בדיקת הקרוואן, הציוד שלו, וחתימה על מצב הקרוואן.
החזרת הקרוואן בסיום ההשכרה
יש להחזיר את הקרוואן בין השעה 8:00 ל-9:00 לכל המאוחר. אפשרי בשעות אחרות בתיאום מראש ובתוספת תשלום.
במקרה של איחור בהחזרת הקרוואן עד שעה - יחוייב קנס של 50 €.
כל שעת איחור נוספת תחוייב ב-100 €.
יש להחזיר את הקרוואן לאותו מקום ממנו הוא נלקח אלא אם הוסכם אחרת. יש להחזיר את הקרוואן באותו מצב בו הוא נלקח. בעת החזרת הקרוואן יש לוודא:
• מיכל המים האפורים מרוקן
• מיכל הדלק מלא (מילוי מיכל שהוחזר לא מלא יחוייב ב-30 € בתוספת לעלות הדלק שצריך למלא)
• ריקון וניקוי מיכל השירותים
בהחזרת הקרוואן, הדו"ח שמולא בעת לקיחת הקרוואן יקבע את מצב הקרוואן. כל נזק או תקלה שלא דווחו, יחוייבו בהתאם למחירון.
במקרה של החזרה מאוחרת של הקרוואן כתוצאה מכוח עליון, על השוכר לעדכן טלפונית ולספק סיבה לאיחור ושעת החזרה משוערת. אין אפשרות להאריך את תקופת ההשכרה ללא סיכום מראש.
אסור לעשן בקרוואן. במקרה של הפרת כלל זה השוכר יחוייב בתוספת דמי ניקיון של 100 € שיילקח מדמי הפיקדון.
ניקיון הקרוואן
בעת לקיחת הקרוואן, השוכר מחוייב בדמי הכנה על סך 150 € - דמי ההכנה הם חובה.
סכום זה כולל את העברת הקרוואן, מדבקה על אגרת כבישים, כימיכלים לשירותים. הקרואן מתקבל כשהוא נקי מבפנים ומבחוץ ומיכל מים אפורים ריק. על הקרוואן לחזור עם אותם תנאים. במקרים של החזרת הקרוואן מלוכלך באופן קיצוני, ו/או אי ריקון וניקוי של מיכל השירותים יחוייב בקנס בהתאם למחירון.
תיקונים ונזקים של הקרוואן במהלך ההשכרה
חל איסור מוחלט על עשיית שינויים בקרוואן (מנוע ו/או ציוד הקרוואן) ללא קבלת אישור מראש. עלויות עבור תיקונים שנעשו ללא תיאום וקבלת אישור מחברת ההשכרה אינן מוכרות. תיקונים מאושרים לעשות אך ורק במוסכי שירות של פיאט ורנו בהתאם להנחיית חברת ההשכרה.
אחריות השוכר וכללי התנהגות במקרה של תאונה
החוק מחייב את הנוהגים להיות בני 21 ומעלה ובעלי רישיון נהיגה לפחות 3 שנים.
במידה וחברת הביטוח מסרבת - מכל סיבה שהיא - לשלם על נזקים שנגרמו לקרוואן, השוכר מחוייב לכסות את כל העלויות בעצמו.
במקרה של תאונה, השוכר חייב למלא דו"ח - הדו"ח האירופאי במקרי תאונה - ולדווח על התאונה למשטרה.
בעת החזרת הקרוואן הפגוע, השוכר מחוייב למלא דו"ח על התאונה. השוכר מחוייב למסור לחברת ההשכרה את כל הדו"חות והמסמכים הרלוונטיים כולל שרטוט של מקומות הנזקים. הדו"ח המשטרתי חייב לכלול את השמות והפרטים של כל המעורבים בתאונה וכן את פרטי כל הרכבים המעורבים.
השוכר לא מוגבל באחריות ויישא במלוא העלות במקרה של נזק הנגרם כתוצאה מנהיגה של נהג שלא קיבל אישור חתום מחברת ההשכרה, במקרה של עומס יתר, שינוע חומרים או אנשים לא חוקיים ללא המסמכים המתאימים, וכן כל מה שאסור ע"י החוק הסלובני.
המפתחות ומסמכי הקרוואן ועבירות תנועה
השוכר מתחייב לשאת איתו בכל זמן את מסמכי הקרוואן והמפתחות. במידה ולא יעשה כך, הביטוח לא יכסה הוצאות שיגרמו בשל איבוד המפתחות או המסמכים.
השוכר יישא באחריות על עבירות התנועה או העונשים שיוטלו במהלך ההשכרה.
אחריות חברת ההשכרה
בעת לקיחת הקרוואן, חברת ההשכרה מתחייבת לספק קרוואן ללא דופי מבחינה טכנית, ללא נזקים שלדעתה יכולים לגרום לתאונה. חברת ההשכרה אינה אחראית על חפצים וציוד שהושארו בקרוואן ללא השגחה, או שנשכחו בקרוואן, בדרך או בסיום ההשכרה.
הוראות כלליות
החוזה נעשה בשני עותקים. עותק אחד בידי חברת ההשכרה והשני נשאר אצל השוכר. במקרה של מחלוקות - סמכות השיפוט היא בידי בית המשפט של נובו מסטו.
קבלת התנאים
בעת חתימת החוזה, השוכר מאשר כי הוא מודע לתנאים הכלליים ומחוייב לכבד וליישם אותם לחלוטין.
Both parties, therefore the lessee and the lesser, obligate with the signing of these general terms and conditions of motorhome rentals to abide by them. The lessee undertakes to be treated with the vehicle as a saver and that it will not be intentionally vandalized and exposed the hazards.
THE RESERVATION AND THE PAYMENT TERMS
The lessee signs at the booking confirmation a contract with a note: "I am familiar with general terms and conditions of motorhome rentals and I accept them.” Thus everything what is stated in these terms and conditions become a legal obligation for the lessee and the lesser. The applications submitted by telephone or Internet are considered that the lessee accepts these terms and conditions when he have booked the motorhome by the phone or Internet. An essential condition for the validity of such an application is to make a payment in accordance with the currency.
At the booking confirmation of the vehicle, 40% of the total value of the rent is paid. The total amount of the rent, in the high season, has to be settled at the latest 20 days before departure, otherwise the vehicle reservation is regarded as cancelled.
THE CANCELLATION OF THE RESERVATION
The cancellation of the reservation is charged with the cost of cancellation of the reservation.
In case of no cancellation and no show, 100% and the additional costs that would be incurred due to cancellation.
The lesser with the participation of the insurance company offers an insurance "Risk cancellation".
If the lessee is unable to attend the trip, he can change (transfer) his reservation to another passenger who meets the requirements but must inform the lesser. For each modification of already confirmed reservation and if the modification is still possible, the lesser charges the lessee for administrative costs in amount of 35 €.
Any change in the date of travelling within one month of departure is considered as a cancellation, for which the cancellation table of costs is valid.
THE SECURITY DEPOSIT AND THE HANDOVER OF THE VEHICLE
At the vehicle handover should be 1000 € of security deposited to lesser by credit card or cash.
This amount is intended to cover the following eventual costs incurred in the duration of the vehicle rental:
• 1% of the value of the vehicle deductible franchise by the comprehensive insurance in case of an accident or a theft of the vehicle
• the loss of bonus with the insurance company
• the missing and/or damaged equipment
• the repairs and damages, which are not included in the comprehensive insurance (damaged equipment because of carelessness ...)
The security deposit is returned to the lessee if the equipment and the vehicle are not damaged or there is any damage caused by a vehicle on returning the vehicle, without interests.
In case of causing an accident or be involved in an accident the security deposit is entirety forfeited, but for inventory damages or things that are not covered by the comprehensive insurance the security deposit is forfeited by the charged costs for damages to be remedied.
In case of major damages or theft of the vehicle, the lessee is obligated to call the police and to submit the police report on returning the vehicle. Otherwise, the lessee covers the costs entirely on returning the vehicle to its original state. Upon the occurrence of an accident and damage to the vehicle (even smaller) is required to immediately inform the lesser about the situation.
THE TIME OF THE HANDOVER OF THE VEHICLE AND THE DURATION OF THE RENT
The vehicle rents from Friday to Friday (7, 14 and 21 days rental) in high season. The rental shorter than 7 days is not possible in the high season, except by special arrangement. The rental shorter than 7 days is possible outside the high season.
The handover of the vehicle is between 12 PM and 16 PM. In exceptional circumstances, by special agreement and extra cost it is also possible otherwise.
The handover is confirmed by an examination of the vehicle (the equipment, the body, the engine) and the mutual signature of the rental report that is the basis for the handover and obligate the lessee and the lesser.
THE RETURN OF THE VEHICLE AFTER THE RENT
The vehicle is required to be returned between 8 AM and 9 AM at the latest. Different arrangements are also possible outside the season by special agreement and extra cost (recorded in the handover report).
In case of a delay in returning the rented vehicle up to 1 (one) hour a fee of 50 € is charged.
Any further delayed hour is charged at a fee of 100 €.
The vehicle is returned to the same place from where it was rented, unless the rental report specifies otherwise. The vehicle must be returned in the same condition as it was received by the lessee at handover. The vehicle must have:
• the empty tank of the wastewater
• the full tank of fuel (the pointer on the top bar of the instrument on the dashboard -filling the fuel tank is charged 30 € and costs of the missing fuel)
• the empty cassette and the cleared toilet
On returning the vehicle the handover report is used to determine the condition of the vehicle and check the operation of all devices in the vehicle. All identified deficiencies and damages are noted in the handover record and charged according to the price list.
The lessee is liable for any damages and deficiencies identified on returning or during handover. In case of late return of the vehicle (force majeure) the lessee is obligated to inform the lesser the cause of the delay and the foreseen time of returning the vehicle by the telephone. The extension of the rent without the prior agreement is not possible.
THE VEHICLE IS STRICTLY NON-SMOKING. In case of disrespecting this provision, the lessee is charged an additional cleaning of 100 €, which is charged with the security deposit.
THE CLEANNESS OF THE MOTORHOME
At the handover the lessee is charged a mandatory final cleaning of the vehicle in amount of 150 €.
This amount also includes the handover of the vehicle, the Slovenian vignette, the chemicals for the toilet etc. The lessee handovers the vehicle, which is cleaned inside and out, with an empty tank of the wastewater. The vehicle is returned in the same condition. In case of extremely dirty vehicle and/or non-emptied toilet cassette the additional costs of the cleaning is charged according to the price list.
THE REPAIRS, DAMAGES OF THE MOTORHOME DURING RENTAL
All the interventions in the vehicle (in both the motor or in the living part) without a prior arrangement with the lesser are prohibited and for them the lessee is materially liable. The costs of repairs which have not been coordinated and approved by the lesser are also not acknowledged. The arranged procedures of the vehicle abroad are allowed to perform only at the authorized service for the FIAT and RENAULT vehicles by a prior arrangement with the lesser.
THE LIABILITY OF THE LESEE AND THE BEHAVIOUR IN A TRAFFIC ACCIDENT
The provisions of the law about CPP require that the lessee must be at least 21 years old and has to have a valid driving licence for at least 3 years.
If the insurance company refuses to pay for the damage caused on the rented vehicle from any cause, the lessee is obligated to cover the damage entirety.
In case of the traffic accident the lessee must fill out a form - the European report of the traffic accident and report the accident to the police.
On returning the damaged vehicle the lessee is obligated to fill in a report about the accident. The lessee must give the lesser the proper documentation and add a sketch about the damages of the motorhome. The police report must include the names and details of all participants in the accident, the numbers of the green card for all of the participating vehicles in a traffic accident.
The lessee is unlimited liable in case of damage caused by the driver´s driving, who does not have a signed authorization for the managing the vehicle from the lesser (an unauthorized driver for driving a rented motorhome), excessive load (total permissible weight of the vehicle is 3500 kg), transporting illegal substances and persons with unarranged documents or without documents ... in short, everything that is not permitted under the legislation in the Republic of Slovenia.
For damages that are not derived from traffic accidents the lessee is liable.
In case of a breakdown, who do you have to contact?
In the unfortunate case of a breakdown, please follow these instructions:
In case of a breakdown which is disabling the vehicle from driving, please call the rental center customer service or to the road side assistance service.
In case of any accessories failure which does not disabling the vehicle from driving (such as Heater, aircondition, fridge, water, etc.), please call the rental center customer service during working hours.
In the unfortunate case of emergency, caused by road accident, personal incident or an unexpected issue please call Bandana Caravan. Please bear in mind that out of working hours we are handling emergency calls only.
Please bear in mind there is no "Alternative motorhome".
THE KEYS AND THE DOCUMENTS OF THE VEHICLE, TRAFFIC OFFENSES
The lessee obligates himself to carry the documents and the keys of the vehicle (an ignition key, a key to lock the door) with him at all times when leaving the vehicle. Otherwise, the insurance does not cover the costs incurred in case of a theft of the vehicle or a loss of these on the road.
All potential offences or penalties arising from this address and incurred during the rental of the vehicle are loading the lessee who is also materially and criminally liable.
THE LIABILITY OF THE LESSOR
At departure, the lesser makes sure that the motorhome is technically faultless and without any damages, which in his opinion can be the cause of the accident. The lesser is not liable for the things that have been left or forgotten in the motorhome, on the road or at the end of the rent.
THE GENERAL PROVISIONS
The terms are written in two identical copies. The lessee receives a copy at the handover of the motorhome, but other remains the lesser of the motorhome. The court in Novo mesto has the jurisdiction for any eventually disputes.
THE ACCEPTANCE OF THE TERMS
The lessee with his signature confirms that he is aware of the general terms and conditions for motorhome rentals and obligates to respect and implement them entirely.
